Singapore's data centre sector is about to move from voluntary green commitments to statutory obligation, and the shift deserves more attention than it has received so far.
On 1 July 2026, the Ministry of Digital Development and Information (MDDI) and the Infocomm Media Development Authority (IMDA) released the draft Digital Infrastructure Bill for public consultation, with feedback closing on 22 July. Buried inside what is largely a security and resilience framework is a change that matters enormously to anyone working in green buildings, energy efficiency, or corporate decarbonisation in this region: for the first time, power usage effectiveness (PUE) will become a licensing condition, not a badge you volunteer for.
What's actually in the Bill
The mechanics are straightforward once you strip away the legal language. Any data centre with a critical IT load of 3 megawatts or more will need a new DC license to operate. When IMDA assesses that application, it won't just look at whether the operator can run a facility competently. It will weigh energy efficiency, water efficiency, the characteristics of the energy source (how much of it is renewable, how carbon-intensive the grid mix is), and the facility's strategic or economic value to Singapore.
A second, tighter tier applies to what the Bill calls major foundational digital infrastructure: data centres with at least 10MW of critical load, or cloud service providers earning S$100 million or more a year from Singapore customers through IaaS or PaaS offerings. These operators face additional obligations around business continuity, disaster recovery, and cybersecurity incident reporting, on top of the sustainability conditions that apply to all licensed DCs. Non-compliance carries real teeth: penalties of up to S$1 million or 10 percent of Singapore annual turnover.
Crucially, this isn't a new-build regime. The government has been explicit that PUE standards will apply across the existing stock of facilities as operators refresh equipment, not just to greenfield developments. That's the detail that should get every facilities and sustainability team at an incumbent data centre operator paying close attention now, well before the specific thresholds are gazetted.
Why this is the right sequencing, not overreach
I've sat through enough conversations with building owners and operators over the years to know the standard objection to mandatory efficiency standards: that voluntary roadmaps and market incentives should be given more time to work before the government reaches for a license requirement. In this case, that argument runs thin. Singapore has already run the voluntary phase. The Green Data Centre Roadmap launched in 2024, the BCA-IMDA Green Mark for Data Centres has existed for the better part of two years, and an energy efficiency standard came out in mid-2025. IMDA and MDDI have said plainly that voluntary measures alone cannot deliver consistent outcomes across the sector, and the numbers back that view. With Singapore projected to draw close to a fifth of its national grid capacity for data centres in 2026, a higher share than any other country, the gap between best-in-class and average-performing facilities has real system-level consequences, not just reputational ones for individual operators.
There's also a resource-scarcity logic here that's specific to Singapore and worth stating plainly for readers outside the city-state. This is a market with essentially no land to spare and grid capacity that has to be planned years in advance. A voluntary framework lets the best operators self-select into good practice while the rest continue business as usual, which is exactly the outcome the government cannot afford when AI-driven demand is compounding energy intensity from every direction. Moving PUE from a rating scheme to a licensing condition closes that gap by construction.
What operators and investors should be doing now
The specific PUE thresholds haven't been set. MDDI has said these will be calibrated through further consultation and released as separate regulations and codes of practice once the Bill passes, benchmarked against international norms rather than picked in isolation. That gives operators a narrow but real window.
Three things are worth doing during this window rather than after the thresholds land. First, get an honest read on where your existing facilities sit against Green Mark for Data Centres benchmarks today, because that gap is about to become a compliance gap, not just a certification gap. Second, treat equipment refresh cycles as PUE upgrade opportunities rather than like-for-like replacements, since the government has signposted that this is exactly the mechanism it expects to use to lift the existing stock. Third, for anyone financing or underwriting data centre assets in Singapore, start pricing regulatory PUE risk into due diligence now. A facility performing adequately against a voluntary Green Mark tier may not clear a mandatory licensing bar once thresholds are set with enforcement behind them.
The bigger signal
This Bill is a useful marker for where Singapore sustainability policy is heading more broadly. The Green Plan era leaned heavily on roadmaps, standards, and grants to shift market behaviour. What we're seeing now, across data centres, and arguably in parallel conversations around industrial decarbonisation and building performance, is a second phase where the most energy-intensive and economically significant sectors get moved from encouragement to enforcement once the voluntary tools have done what they can. Data centres happen to be first because the numbers are too stark to ignore. They are unlikely to be last.
